Terms of Service

These terms are the agreement between you and DUSTY LLC. Using Dusty means you accept them.
Who can use Dusty
You must be 18 or over and in the United States. We check your age at sign-up using Apple's age-range signal, and refuse anyone we cannot confirm is an adult.
One person, one account. If we remove your account, you may not make another.
What Dusty is
You are introduced to one person a day around one public-domain artwork. You can talk until midnight in your own time zone. The conversation ends there unless both of you hold to keep it. If only one of you holds, nothing is announced to either of you.
There is no browsing, no searching, no swiping and no way to contact anybody you have not been matched with. Two people who have been matched are never matched again.
We do not promise you a match on any given day. If nobody suitable is nearby, there is no match, and that is the service working as designed rather than failing.
What you may not do
Do not use Dusty to:
ask anyone for money, cryptocurrency, gift cards or investment advice;
send sexual content to somebody who did not ask for it;
threaten, harass, stalk or intimidate anyone;
pretend to be somebody you are not, including using another person's photographs;
use the service if you are under 18, or attempt to reach anyone who is;
post anything unlawful, or anything that infringes somebody else's rights;
collect information about other people, or automate access to the service.
Photographs must be of you. The first must be taken inside the app, which is why the app asks for the camera and not your library.
Reporting, and what happens next
Every conversation can be ended and reported. Reporting always ends the conversation, and sends us the conversation and both profiles. The person you report is never told that you reported them, at the time or afterwards.
Review
A person on our team reads every report, within 72 hours.
Two reasons act before anybody reads them: a report that somebody threatened you, or that somebody is a child, suspends that account immediately. That is protection rather than a judgement, and a person still reviews it.
Outcomes
No action — The block stands regardless. You are not told. A warning — Once only, shown before the next match. Suspension — No matches for seven days. We tell the account why. Removal — Permanent. Any live conversation ends immediately. Law enforcement — We report credible threats to life and any sexual content involving a minor. Reporting child sexual abuse material to NCMEC is a legal obligation, not a choice.
If a decision has been made about your account and you believe it is wrong, you can appeal it. An appeal is read by somebody who was not involved in the original decision.
What you write and post
Your sentences, your messages and your photographs remain yours. You give us permission to store them and to show them to the person you are matched with, so that the service can work at all. That permission ends when the content is deleted, except where we are required to keep something for a report, a legal obligation, or the record described in our Privacy Policy.
You confirm that you have the right to post what you post, and that your photographs are of you.
Ending it
You can delete your account at any time, in the app, under you → delete everything. It is not reversible.
Conversations you were part of stay readable by the other person, with your name attached to an account that no longer exists — they were their conversations too. Our Privacy Policy explains this in full.
We may suspend or remove an account that breaks these terms, or where we reasonably believe somebody is at risk.
Safety
We review reports and act on them, but we do not run background checks on anybody using Dusty, and we cannot verify that people are who they say they are. Meeting a stranger carries risk that no app removes. Meet in public, tell somebody where you are going, and do not send money to anybody you have met here — no genuine emergency requires a stranger's bank details.
If you are in immediate danger, call 911. If you are in crisis, the 988 Suicide & Crisis Lifeline can be reached by calling or texting 988.
The service itself
Dusty is provided as it is. We do not promise it will always be available, that matches will suit you, or that it is free of faults. We may change or stop features, and we will tell you in the app if a change affects you materially.
Limits
TO THE FULLEST EXTENT PERMITTED BY LAW, DUSTY LLC IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR FOR THE CONDUCT OF ANY OTHER USER, WHETHER ONLINE OR IN PERSON. OUR TOTAL LIABILITY TO YOU IS LIMITED TO THE AMOUNT YOU HAVE PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR ONE HUNDRED US DOLLARS, WHICHEVER IS GREATER. SOME STATES DO NOT ALLOW THESE LIMITS, AND WHERE THAT IS SO, THEY DO NOT APPLY TO YOU.
Disputes and governing law
These terms are governed by the laws of the State of Connecticut, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Connecticut, and you and we each consent to that.
Nothing here prevents either of us from seeking an injunction, or you from bringing a claim in small-claims court, or from complaining to a regulator.
Changes to these terms
If we change these terms in a way that affects you, we will tell you in the app before the change takes effect.
